SUBJECT: PROCEDURE FOR FLOATING HOLIDAY TIME

Pursuant to our recent discussions regarding floating holidays, this memorandum will outline the procedure to be followed as of July 1, 1995. This procedure will not change unless approved in writing by both parties.

We agreed that pursuant to Article V. Section B. of the 1995-1997 BCEA MOU all full-time represented employees, unless otherwise specified below, are entitled to sixteen (16) hours of floating holiday per fiscal year. In addition to these floating holiday hours, such employees are entitled to 10.5 fixed legal holidays per year as specified in Article V. Section B.2. The .5 (four hours) fixed holiday is either for Christmas Eve or New Year's Eve. If an employee works both of these days, the employee shall be entitled to additional compensation for the four (4) hours holiday worked as provided in the rule on overtime.

Employees in the Refuse Section on the Incentive Program are not entitled to any of the 10.5 fixed legal holidays, except for December 25th, known as Christmas Day. In addition, these Incentive Program employees are entitled to twenty (20) hours of floating holiday each fiscal year.

Any other BCEA employee who receives a differential under Article II, Section H. for working holidays is not entitled to any of the 10.5 fixed legal holidays. However, these employees are entitled to twelve (12) hours of floating holidays each fiscal year.

Floating holiday hours shall be pro-rated for part-time employees and employees hired after July 1st of each year in a manner identical to personal leave. Payment for unused floating holiday time shall be paid at the end of each fiscal year not to exceed sixteen (16) hours.
